A written request has its own deadline

Under Labor Code 1776, contractors have 10 days to produce records after a written request. After that, the penalty is $100 per worker per day. Read the request and record its dates before sorting the payroll file.

Missing reports can affect project payments

Under Labor Code 1771.5, an awarding body that runs a labor compliance program withholds contract payments when payroll records are delinquent or inadequate. Labor Code 1776 also lets the Labor Commissioner have records penalties withheld from progress payments. Review the project’s correspondence and payment requirements alongside the missing reports.

Steps to take now

Use the notice to define the records review. Keep the original request and its attachments with your project file.

  • Record when the request arrived and the production deadline stated in it.
  • Identify the project, workers and payroll periods requested.
  • Gather time records, payroll reports, fringe benefit records and filing confirmations.
  • Compare requested records with what was submitted, and list missing or inconsistent items.
  • Contact our team to discuss preparing the records and filings; keep copies of what you furnish.
