Calendar the written request immediately

Labor Code 1776 gives a contractor 10 days after a written request to produce payroll records. Failure carries $100 per calendar day per worker, which DLSE can have withheld from progress payments. Record receipt and assign responsibility for the response before beginning a wider cleanup.

Collect more than a payroll summary

The Labor Commissioner’s manual describes payroll support broadly, including time cards, canceled checks, trust fund forms and documents reflecting job assignments, schedules and disbursements. Build an index of the requested periods and workers so missing items are visible before the response is assembled.

Review classifications and certification

The manual says records should use the classification title in the wage determination, not merely journeyworker or apprentice. Certified records include a written declaration under penalty of perjury that the information is true and correct. Have the responsible signer review the supporting information before certification.

Match disclosure to the requester

The manual describes different redactions for public requests and joint labor-management committee requests. Do not send a public copy containing worker identifiers or assume the same redaction approach applies to every recipient. Confirm the requesting authority and required disclosure with the appropriate adviser.

Treat the request separately from routine eCPR

The manual explains that routine electronic filing does not excuse a response to a written records request. Separately, Labor Code 1771.5 requires an awarding body operating a labor compliance program to withhold contract payments when payroll records are delinquent or inadequate. Preserve the actual response and delivery evidence alongside the original request.
