Start with the employer’s holiday commitment

DIR says California law does not require paid holidays, business closure or a day off for a particular holiday. Paid holidays arise from an employer policy or practice, collective bargaining agreement or employment agreement. Read the applicable commitment before answering an employee’s pay question, and keep the approved policy available to the payroll preparer.

Treat holiday work as work when checking overtime

A holiday, Saturday or Sunday does not by itself create a state-law premium. DIR treats those worked hours like hours on other days, with overtime rules still applying. A separate employer promise may affect the amount paid. Use actual time records and the applicable policy to explain the paycheck.

Keep an unworked paid holiday out of worked-hour totals

DIR’s holiday guidance bases overtime on hours worked rather than pay received. Paid holiday hours that were not worked do not count toward the 40-hour weekly overtime threshold. Use separate time categories so a paid absence does not silently become worked time in a weekly calculation.

Review daily and consecutive-day rules as well

The overlapping DIR overtime guidance calls for time and a half for hours over eight through twelve in a workday and the first eight hours on the seventh consecutive workday in a workweek. Double time applies above twelve daily hours and above eight on that seventh day. Review applicable exceptions with your employment adviser; a holiday label does not replace the overtime analysis.

Explain the paycheck using policy and attendance records

For a practical review, compare the holiday calendar, approved policy, timecard and payroll earnings lines. Identify which amounts represent worked time and which represent the employer’s paid holiday benefit. Resolve conflicting instructions before payroll approval and retain the explanation for the employee and future payroll reviewers.
